Terms & Conditions

Please take the time to read these terms and conditions. By using our website and the services and information offered on our website, you are agreeing to these terms and conditions.

If you purchase products through our website, there will be additional terms and conditions relating to the purchase.  Please make sure you agree with these terms and conditions, which you will be directed to read prior to making your purchase.

Class refunds

We understand that things come up in life, but as a business, there are a few factors involved with reserving and holding seats. We purchase supplies weeks in advance in preparation for classes, so your supplies are allocated after you purchase a ticket. Your reservation also means someone else may miss out, so we don’t get as great of an opportunity to fill it, especially close to the event.

For this reason, Brushes & Booze does not offer refunds for public or private classes.

For public classes, we gladly offer the option of a free credit transfer to those who let us know 48 hours in advance. If a credit transfer is requested within 48 hours of the session start time, you will be charged a $10 per seat fee. You can use this credit any time within 12 months after it was issued and can transfer to any class that has the same or cheaper ticket cost. Simply email hello@brushesandbooze.com to rebook.

Group bookings may be cancelled or rebooked up to 1 week before the scheduled session, otherwise, each seat will incur a $20 cancellation/rebooking fee. A credit can also be issues and can be redeemed within 12 months.

All No Shows for public and private classes are charged the full amount without a refund. This is not negotiable and includes calling in sick or change of personal circumstances.

The Office of Fairtrade advises that we are not required to offer a credit or refund for change of mind and that transfer fee for such events are legal and can be applied.

BYO

Classes held at private locations such as a house or public area are BYO. Classes held at licenced venues are not BYO as alcohol can be purchased from the venue.

Events postponed or cancelled by us

Public events

If we require to postpone a public event, you will be notified ASAP with a new date along with additional information. If you are unable to make the date of the new class, we will issue a credit which can be used on a class of the same cost or less within 12 months. Refunds will not be issued as we purchase supplies well in advance.

Private

If we require to postpone a public event, you will be notified ASAP and a new date will be organised with the host. If a new date cannot be arranged, you will receive a credit which can be used to book another private class within 12 months of issue.

Pandemics, epidemics, floods, fire, riots and all other society lockdown

This policy has been put into place to keep us and you safe. If we are required to go into lockdown, you will be notified ASAP that the class you have booked has been put on hold. After lockdown has lifted, public classes will be rescheduled 4-6 weeks later to give everyone a chance to make it, and public classes will be rescheduled at the next convenience. If you’re unable to attend the public class or book a new date for your private class, a credit will be issued that can be used within 12 months. Refunds will not be offered if you can not attend the new date.

If lockdown exceeds 30 days, we will proceed will blanket refunds week by week as lockdown progresses until we are able to recommence trade.

Bad weather and resulting postponed events

Public events

Cold and flu symptoms

Private events

If you or someone in your party develops cold and flu symptoms, they must not attend the class. We gladly offer the option of a free credit transfer to those who let us know 48 hours in advance. If a credit transfer is requested within 48 hours of the session start time, you will be charged a $20 per seat fee. This credit transfer can be used up to 12 months after being issued at another private class or public class.

If catering is included in the private or public class ticket, we’re unable to transfer this portion of the ticket as the venue/business has already prepared your order. If you feel you should be refunded for the ticket, you’re welcome to speak with the venue directly.

Late arrivals

We’re unfortunately unable to wait for late arrivals. Our classes are carefully timed, and waiting will affect the finish time and cause complaints. If your ticket includes a meal and you miss this portion of the event, we’re unable to issue a refund for the food but you can attend the painting portion of the event.

No shows

All No Shows are charged the full amount without a refund.

Change of mind

The Office of Fair Trade advises us that we do not need to offer a credit or refund for change of mind. If you would like to transfer classes, you can do this for an additional $10.

Class photos/photos taken throughout the class

We take photos of the class to advertise Brushes & Booze and promote events. If you do not feel comfortable being included in these photos, please let the teacher know. We will always respect this choice.

These images are property of Brushes & Booze which are used on social media, our website, print material and various other customer touchpoints. You’re welcome to take your own photos and share them, but we ask that these images depict our property and are not used to advertise competitors.

Change of circumstances

We do not offer a refund for the customer’s change of circumstances. If you provide us 48 hours notice, we will offer a credit. If a credit transfer is requested within 48 hours of the session start time, you will be charged a $10 per seat fee.

Group booking cancellation

Group bookings may be cancelled or rebooked up to 1 week before the scheduled session, otherwise, each seat will incur a $20 cancellation/rebooking fee.

Group bookings – failure to meet 6 people

If you book a private event, you are required to pay for 6 seats. If you are unable to meet the minimum amount of people, you are required to pay for the remaining seat regardless. So if you have a group of 5 or the 5th person can’t make it, you will be paying for 6.

We will not cancel the event or refund as this is considered a change of mind under the ACCC. The event date can be rebooked outside of the 1 week notice period, or within the one week notice period and each seat will incur a $20 cancellation/rebooking fee. A credit can also be issues and can be redeemed within 12 months.

Food handling

Due to the perishable nature of the food provided, S&O Grazing strongly recommend that the grazing boards are always set up out of direct sunlight, whether that be indoors or in a shaded, cool area.

After we deliver the grazing boards, Brushes & Booze and S&O Grazing do not accept any liability for any loss or damage that may occur directly or indirectly with the grazing board in relation to presentation and location if the recommendations are not followered.

Allergy advice

Brushes & Booze is proud to offer S&O Grazing to our valued customers.

S&O Grazing caters all Picnic, Paint & Graze events. Brushes & Booze is not liable for any adverse medical reaction that may occur directly or indirectly with the S&O Grazing catering.

Due to the nature of the product, please be aware that the grazing boards may contain the following ingredients:

Wheat, dairy, eggs, soy, fish or shellfish.

Gluten and nut free options can be provided upon request.

Website use

The website is made available for your use on your acceptance and compliance with these terms and conditions. By using this website, you are agreeing to these terms and conditions and the following:

  • You will use this website in accordance with all applicable local, state, national and international laws, rules and regulations
  • You or a third party will not use this website for any purpose that is unlawful, defamatory, harassing, abusive, fraudulent, obscene or any other inappropriate way

Currency and pricing

All amounts stated on our website are in Australian Dollars.  We reserve the right to change our pricing at any time.

All prices quoted on this website include a 10% Goods and Services Tax (GST) unless specified otherwise.

Passwords and logins

You are responsible for maintaining the confidentiality of your passwords and login details and for all activities carried out under your password and login.

Limitation of liability

Content and statements on the website and services are intellectual property owned by Brushes & Booze. All of our services are provided without a warranty with the exception of any warranties provided by law. We are not liable for any damages incurred from the use of our website or our services.

Indemnification for loss or damage

You agree to indemnify us and hold us harmless from any liabilities or expenses arising from or are related to our website or services. This includes any liabilities, claims, losses, damages (accidental or consequential, suits, judgements, litigation costs and solicitors’ fees by you or a third party.

Intellectual property and copyrights

We own the content of this website, including all files, data, graphics, articles, news, tutorials, videos, reviews, forum posts and databases contained on the website or in connection with the services. Subjects can be copied to improve one’s artistic skills but cannot be sold.

Accuracy of content

We have taken proper care and precautions to ensure that the information we provide on this website is accurate. However, we cannot guarantee, nor do we accept any legal liability arising from or connected to, the accuracy, reliability, currency or completeness of anything contained on this website or on any linked site.
